Understanding the shared living market
in Luxembourg

Flat-sharing, co-living, shared accommodation, furnished rooms: these terms cover different situations, each with its own rules and implications for your plans. Here’s a guide to help you make sense of it all.
01 · Definitions

Four words, four realities

Flat share

Several people who are not related rent the same property together and share communal areas. The Act of 23 July 2024 now specifically regulates this arrangement, in particular through the single tenancy agreement between flatmates and the flat-sharing agreement entered into between them. No change in the property’s designated use. Limited technical constraints.

Furnished rooms

Each occupant rents a furnished room on an individual basis and shares certain communal areas. Depending on the layout of the property and the regulations applicable in the local authority area, the project may require a change of use and work to bring the property into compliance. Factors such as room sizes, ceiling heights, bathroom facilities, ventilation and fire safety – as set out in the Act of 20 December 2019 – may be particularly relevant.

Living together

The owner continues to live in their home and shares part of it with one or more people.
However, the layout of the premises, the possibility of registering a business address there, and the necessary procedures with the local council must be checked before the property is let.

Co-living

The term ‘coliving’ generally refers to a form of shared accommodation which, in addition to housing, offers various facilities and services: private bathrooms, workspaces, a gym, a laundry facility, events, etc.
Co-living does not in itself constitute a separate legal status. The applicable framework depends on how the accommodation is organised and let.
02 · The regulatory framework

What are the regulations governing shared
accommodation in Luxembourg?

Three levels of rules may be applied simultaneously.
And every local authority has its own approach. The same building may therefore comply with the regulations when used as a shared flat, but not as furnished rooms – or only after alterations have been made.
That is why MyColoc analyses the project before determining the most suitable shared living arrangement and the necessary steps to be taken.
Tenancy lawThe Residential Tenancy Act of 23 July 2024

The law sets out the relationship between landlords and tenants and introduces the concept of shared tenancy, which allows a property to be let to several people who are not members of the same family, provided that they sign a single tenancy agreement and a set of house rules governing communal living.

Health and safetyGrand-Ducal Regulation of 20 December 2019

Accommodation and rooms let out must meet minimum standards in terms of health, hygiene, safety and habitability. The requirements relate in particular to the floor area of bedrooms and living areas, ceiling height, natural light, sanitary facilities and fire safety.

Local urban planningLocal Planning Policy and Building Regulations

In addition to national regulations, each project must be assessed in accordance with the regulations applicable in the local authority where the property is situated. In particular, the General Urban Development Plan (PAG), the Local Urban Development Plan (PAP) and building regulations may govern the use of the building, the scope for conversion, parking arrangements or certain characteristics of the dwellings.

The rules may therefore vary from one local authority to another. A project that is feasible in one local authority is not necessarily feasible under the same conditions in another.
